The Union of Jewish Religious Communities in the Republic of Poland, based in Warsaw, the American Jewish Committee Central Europe Foundation, the “Never Again” Association, the Jewish Association “Czulent” in Kraków, and Chief Rabbi Michael Schudrich filed a notification with the prosecutor’s office regarding the possibility that the Mayor of Kalisz and the head of the Kalisz Police committed an offense by failing to fulfill their duty to dissolve a public assembly on November 11 in Kalisz.

According to the law on public assemblies, a representative of the municipal office is obliged to monitor the course of the assembly and respond to incidents that are inconsistent with the law. Responsibility for responding to incidents is shared equally by both the Police and the party representing the municipal office. This means that the presence of the Police performing their duties does not relieve the person monitoring the assembly on behalf of the municipal office of their responsibilities.

Officials who are public officers are obliged to notify law enforcement authorities of a crime committed during a public assembly, regardless of whether the Police witnessed it or whether others have already reported it. Failure to report a suspected crime exposes the municipal official to legal liability under Article 231 of the Penal Code for failure to fulfill their duties, as well as possible criminal sanctions.

We believe that such a situation occurred in Kalisz, which is why the association has taken appropriate action.

In our activities and cooperation with local governments, we consistently recommend that—regardless of the actions of the Police or other institutions—officials with the status of public officers always file a notification whenever there is a reasonable suspicion that a crime motivated by antisemitic bias has been committed during public assemblies.
